Final Offer launches private market listings feature for off-market sales by Kennedy Edgerton for HousingWire

Boston-based negotiation platform Final Offer announced the launch of its new Private Exclusive Listings (PX) feature this week. The new platform will be available in all markets that Final Offer operates in.

Final Offer’s new feature gives agents a new avenue of communication with clients looking for unique listings. According to the company, PX allows agents to share “pre-market” and “off-market” properties with clients via a private channel. Matching listings appear on the client’s saved search channels, alongside MLS listings. Sellers must provide explicit consent for an agent to privately share their property.

Pre-market and off-market listings have caused some controversy in the real estate industry. Some agents call any non-MLS listings “pocket listings.” States allow agents to legally handle pocket listings, but in 2020 the National Association of Realtors (NAR) banned pocket listings with its Clear Cooperation Policy (CCP).

This prompted a lawsuit initiated by Top Agent Network (TAN) that accused NAR of purposefully suppressing competition. However, both parties settled that lawsuit this month.

Tim Quirk, Final Offer’s co-founder and chief strategy officer, said the new feature will help clients “test the market” before using an MLS.

“This new feature gives listing agents a unique opportunity to test the market, collect offers and make informed decisions about next steps for their sellers, whether that’s transacting off market or bringing on the market with offers publicly registered for all to see,” Quirk said in a prepared statement.

Using PX, agents are also engage in live negotiations and access a “Final Offer Button,” similar to a “Buy Now” button. Agents can also send those listings to a local MLS, if necessary.

PX’s unveiling follows Final Offer’s earlier expansion in North America. In July 2024, Final Offer acquired the North American operations of Openn Negotiation — another negotiation platform and offer platform that operated in Canada.

Second Century Ventures, the NAR’s investment arm, selected Final Offer for it’s REACH tech growth program in 2024 and Second Century Ventures announced a follow-on investment into the company this month. The company has raised close to $16 million in investments from Second Century and over 100 real estate professionals since it’s founding in January 2021.

Final Offer currently operates in 11 U.S. states alongside Ontario and Alberta, Canada.
